Terms of Service

These Terms of Service ("Terms") govern your use of the website at blueprintdigital.pro and any web design, development, or related services ("Services") provided by Blueprint Digital, operated by Bryan Presco in Pennsylvania, United States ("we," "us," or "our"). By accessing our Site or engaging our Services, you agree to be bound by these Terms.

1. Services

Blueprint Digital provides website design, development, and related digital services for small businesses and local clients. Our current service packages are:

Specific deliverables, timelines, and scope for each project are defined in the client service agreement provided prior to commencement of work.

2. Payment Terms

Payment for services is structured as follows:

• Deposit: 50% of the total project price is due before work begins. Work does not commence until the deposit is received.
• Final payment: The remaining 50% is due upon project completion and delivery, before the website is transferred to your hosting or made publicly live.
• Monthly retainer: Monthly maintenance fees are billed on a recurring basis and are due at the start of each billing period.

All payments are processed securely through Stripe. By submitting payment, you agree to Stripe's Terms of Service. Prices are listed in US dollars.

3. Refund Policy

Due to the custom nature of web design work:

• Deposits are non-refundable once work has commenced, as they compensate for time and resources already allocated.
• If you cancel a project before work begins, a full refund of the deposit will be issued within 5 business days.
• If a project is cancelled after work has commenced, no refund will be issued for work already completed. A partial refund may be offered at our discretion based on the amount of work remaining.
• Monthly maintenance fees are non-refundable for the current billing period but you may cancel future billing at any time.

4. Project Timeline and Client Responsibilities

Estimated project timelines are provided at the start of each engagement. Timely delivery depends on your cooperation, including:

• Providing content (text, images, logos) within 5 business days of project kickoff
• Responding to review requests and feedback within 3 business days
• Providing domain and hosting access as needed

Delays caused by late client responses may extend the project timeline without penalty to Blueprint Digital.

5. Revisions

Each project includes a reasonable number of revisions as specified in the project agreement. Revisions are defined as adjustments to the agreed-upon design and scope. Requests that constitute a significant change in scope, direction, or functionality beyond the original agreement may be subject to additional charges.

6. Intellectual Property and Ownership

Upon receipt of full payment, you will own the final website deliverables produced specifically for your project, including custom design layouts and written content you provided. The following are excluded from client ownership:

• Third-party assets (stock photos, fonts, plugins, frameworks, or libraries) which remain subject to their respective licenses
• Proprietary tools, templates, or code frameworks developed by Blueprint Digital prior to or independently of your project
• Any materials for which full payment has not yet been received

Blueprint Digital retains the right to display completed work in its portfolio unless you request otherwise in writing.

7. Client Content and Representations

By providing content (text, images, logos, or other materials) for use in your website, you represent and warrant that:

• You own or have the legal right to use all such content
• The content does not infringe on any third-party intellectual property rights
• The content does not violate any applicable laws

You agree to indemnify and hold Blueprint Digital harmless from any claims arising from content you provide.

8. Limitation of Liability

To the fullest extent permitted by law, Blueprint Digital shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services or website. Our total liability to you for any claim arising from these Terms or our services shall not exceed the total amount paid by you for the project in question.

We do not guarantee any specific business outcomes, search engine rankings, or revenue results from our website services.

9. Governing Law and Dispute Resolution

These Terms are governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to its conflict of law provisions. Any disputes arising under or related to these Terms shall be subject to the exclusive jurisdiction of the courts located in Pennsylvania.

In the event of a dispute, the parties agree to first attempt resolution in good faith through direct communication before initiating formal legal proceedings.

10. Termination

Either party may terminate a project engagement with written notice. Upon termination, you are responsible for payment for all work completed up to the termination date. Blueprint Digital reserves the right to refuse or terminate service for any client who is abusive, fraudulent, or in violation of these Terms.

11. Website Use

Your use of the blueprintdigital.pro website is subject to the following conditions:

• You will not attempt to gain unauthorized access to any portion of the Site or its infrastructure
• You will not use the Site for any unlawful purpose
• You will not scrape, copy, or redistribute Site content without permission

12. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of the Site or our services after changes are posted constitutes acceptance of the revised Terms.
